In a case of first impression for the 4th Court, the court held the TCPA’s “right of association” definition did not apply to various claims based on the sale/communication of seismic data. The majority construed the phrase “common interests” to mean interests affecting the public; the dissent would have construed “common interests” as meaning interests shared by a group of people who freely associate.
