My article in the new issue of the State Bar Appellate Section‘s Appellate Advocate questions whether Texas courts are quietly abandoning the final judgment rule. The final judgment rule, and its numerous exceptions, govern when a trial court’s rulings may be reviewed in the courts of appeals. In my article, I explain why the exceptions are growing so significantly that they “have swallowed the general rule to such a degree that the final judgment rule is no longer properly considered the general rule.”
